1. Acceptance of Terms

By accessing or using Affiche (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. You must be at least 13 years old to create an account. If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information and terminate the account as quickly as possible to comply with COPPA.

2. The Platform & Third-Party Services

Affiche is a curated portfolio and discovery platform for film posters. We use various third-party service providers (such as payment processors, identity managers, and AI APIs) to operate the Platform. Your use of the Platform is subject to our Privacy Policy, which details how your data is handled.

• Film Metadata (Wikidata): Film details and metadata are sourced from Wikidata. You acknowledge that Wikidata content is governed by Creative Commons licenses and belongs to the respective copyright holders or is in the public domain.

3. Content & Upload Guidelines

You retain all ownership rights to the original poster artwork you upload to Affiche. By uploading, you grant us a non-exclusive, worldwide, royalty-free license to display, host (via Convex), and distribute your content across the Platform.

3.1. Human Creativity Policy

Affiche is a platform for human artists. The publication of AI-generated artwork is strictly prohibited. Using AI tools as a minor aid (such as background removal) is permitted, provided it does not replace the core human creative work. Violations of this policy will result in the removal of the content, and may result in account suspension or a permanent ban.

3.2. No AI Training Guarantee & AI Features

We fiercely respect the intellectual property of our artists. Affiche will never use, sell, or license your uploaded artwork to train generative AI models. We do offer an optional, manual AI feature (the "Auto-Detect Film" button) to help detect the poster's film. By choosing to use this feature, you consent to temporarily sending that specific poster to an external enterprise AI provider solely for metadata extraction. These enterprise providers are strictly prohibited by their agreements from using this data to train their foundation models.

3.3. Copyright & Intellectual Property

You must only upload artwork that you have created or have the legal right to distribute. Fan-art is permitted provided it constitutes a transformative work. Do not upload direct rips or unedited screenshots of copyrighted material.

4. Paid Tiers & Trials

Affiche offers paid "Supporter" and "Pro" subscription tiers that unlock advanced features such as unlimited uploads, custom layouts, and advanced statistics.

• Free Trials: We offer a 3-day free Pro trial to our first 200 "founding members." Subsequent signups will be placed directly on our Free tier. If you are on a trial and do not cancel before it ends, you will be billed for the subscription tier selected.
• Billing: Subscriptions are billed on a recurring monthly or annual basis via Paddle.
• Cancellations & Downgrades: You may cancel your subscription at any time. Upon cancellation, your paid features will remain active until the end of your current billing period. Once the period ends, your account will revert to the Free tier.
• Data Retention on Downgrade: If you downgrade, your previously uploaded posters and secondary images will remain safely on the platform, but your active profile will revert to the standard layout and your upload limits will be restricted.
• Refunds: All subscription charges are non-refundable unless otherwise required by law in your jurisdiction.

5. Account Termination

We reserve the right to suspend or terminate your account if you breach these Terms (e.g., uploading AI-generated art or violating copyrights). Where required by consumer protection laws (such as in the EU and UK), we will provide you with a justification for the termination and an opportunity to appeal the decision.
